Background:

Following the running of Race 1, Gore Workouts Trot, Stipendiary Steward,  Mr V Munro filed an information pursuant to Rule 870(3) instigating a protest against SUPERFASTSUPERSTAR (Driver Mr Rory McIlwrick) galloped in excess of 50 metres in the last 200 metres.

The Respondent, Mr R McIlwrick did not contest the protest.

The judges placings were;

Rule 870(3) provides: that any horse which breaks from its gait shall promptly return to its gait.

The Breaking Horses Regulation provides;

b) any horse which breaks from its gait within the final 200 metres of any race and continues to break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has fallen to regain its proper gait.

Where a protest has been lodged against the placing of any horse, the Adjudicative Committee shall either;

1) relegate such horse under Rule 870(4) to behind any other horse in respect of which an advantage may have been gained, or;

2) disqualify it from the race under Rule 1003(2).

Evidence:

Using the video evidence, Mr Munro had identified the horse SUPERFASTSUPERSTAR galloping, and continues on from 150 metres from the winning post, for at least 70 metres.

Mr Munro sought disqualification of SUPERFASTSUPERSTAR.

Reasons for Decision:

After reviewing the video replay and acknowledging the protest was not contested, the Adjudicative Committee was clearly satisfied that SUPERFASTSUPERSTAR had broken free of interference inside the final 200 metres of the race. Accordingly, SUPERFASTSUPERSTAR is in breach of Rule 870(3) and the Breaking Horse Regulation.

Decision:

The protest was upheld and SUPERFASTSUPERSTAR was disqualified.

The amended final placings for Race 1 are;

1st – 7. Cool Phelan (Brent Barclay)

2nd – 8. Johnny Walker (Matthew Williamson)

3rd – 6. George The First (Sheree Tomlinson)

4th – 5. Anteros (Brad Williamson)

It was ordered that dividends and stakes be paid in accordance with the amended result.
