BACKGROUND:

Following the running of Race 1, Riccarton Park Function Centre Maiden, the Respondent, Apprentice Jockey, Denby-Rose Tait, admitted a charge that, as the Rider of JETHRO in the race, she struck her mount 7 times prior to the 100 metres.

Rule 638(3) provides:

(g)     Subject to the other requirements this Rule 638(3), in a Flat Race or trial (including jump-outs and/or tests for certification purposes), a Rider must not:

(i)    strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins.

The Respondent was assisted at the hearing by Apprentice Jockey Mentor, David Walsh.

EVIDENCE:

Stipendiary Steward, Mark Davidson, showed video replays of the final 300 metres of the race. He pointed out JETHRO, ridden by the Respondent, racing in the second half of the field as the field neared the final straight. He then showed that she used her whip on three occasions prior to turning for home and then on four more occasions prior to the 100 metres, seven strikes in total. The Adjudicative Committee noted that the strikes were not forceful and were well spaced.

Mr Walsh said that it was only the Respondent’s 5th raceday ride and she was still learning.

DECISION:

The charge is admitted and is therefore deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said that the Respondent has a clear record. Had she only exceeded the permitted number of strikes by one, she would have received a warning but, for two additional strikes, the Penalty Guide provides for a fine of $250. There were no aggravating factors, Mr Davidson said.

REASONS FOR PENALTY:

The RIB Thoroughbred Racing Penalty Guide suggests a starting point for penalty for a second offence involving two additional strikes of a $250 fine. That is an appropriate penalty, there being no relevant aggravating or mitigating factors.

CONCLUSION:

The Respondent, Apprentice Jockey, Denby-Rose Tait, is fined the sum of $250.
