EVIDENCE:
Following the running of Race 1, Chief Stipendiary Steward Mr Nigel McIntyre, presented an Information alleging a breach of Rule 869(2) by Open Driver Mr Paul Borcoskie.
The hearing of the Information was adjourned sine die and heard at Addington Raceway on 18 June 2023.
Mr Borcoskie stated he was conversant with the Rule, understood the charge and confirmed he admitted the breach.
Mr Sole identified Mr Borcoskie back in the field, on the pylons, entering the home straight. He pointed to Mr Borcoskie use his whip with more than a wrist flicking motion four or five times in the run home.
Mr Borcoskie said ELLAMON is hard horse to get motivated.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Sole said Mr Borcoskie had a warning on 2 April 2023 and the Stewards viewed this breach as low level.
Mr Borcoskie said he would prefer a suspension over a fine.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 2-day suspension or a $300 fine for a first breach at low-level. In the circumstances of this case, the Adjudicative Committee can see no reason to depart from the Penalty Guidelines and accept Mr Borcoskie’s wish to prefer a suspension over a fine.
Accordingly, it determines a 2-day suspension as an appropriate Penalty.
CONCLUSION:
Driver Mr Paul Borcoskie, is suspended from the conclusion of racing today, up to and including racing on the 25 June 2023.
