BACKGROUND:
Following the running of Race 3 Stipendiary Steward, Mr Shane Renault presented an Information alleging a breach of Rule 869(3)(b) by Driver, Mr Blair Wilmott.
Mr Wilmott stated he was conversant with the Rule, understood the charge and that he admitted the breach.
Rule 869(3)(b)
No driver in any race shall drive:-
(b) Carelessly.
EVIDENCE:
Mr Renault played the head on video to identify Mr Wilmott driving ELEPHANTINTHEROOM at the rear of the field on the rail. Mr Renault pointed to Mr Wilmott drive his horse into a gap and make some ground but ran out of racing room and become awkward. At this juncture Mr Wilmott’s horse has contacted the wheel of JAMES CAGNEY (G Smith) and galloped losing all chance. Mr Renault stated Mr Smith advised the Stewards his tyre didn’t deflate when contact was made.
Mr Wilmott had nothing to add to Mr Renault’s description of the incident.
DECISION:
The Respondent having admitted the breach the charge was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Renault said Mr Wilmott has had 7 drives since leaving the amateur ranks and has a clear record. He said the Guidelines provide a $300 fine starting point from which a discount may be considered.
Mr Wilmott made no submissions on Penalty.
REASONS FOR PENALTY:
Harness Racing Penalty Guidelines provides a $300 fine starting point any time a driver hits a wheel.
Mr Wilmott has admitted the breach, has a clear record and has been thoroughly professional throughout the hearing and the Adjudicative Committee considers a $250 fine appropriate in this case.
CONCLUSION:
Driver, Blair Wilmott is fined $250.
