SUMMARY OF FACTS

Following Race 1 Information A18251 was filed with the Adjudicative Committee.

It was alleged that “VIVID NIGHT” (4th) broke in excess of 150m rounding the final bend and early stages of the run home.

Mr John Doody representing the connections of “VIVID NIGHT” did not contest the protest.

Films were shown which showed that “VIVID NIGHT” commenced to gallop near the 450m and continued to gallop for a further 150m and crossed the line in 4th place in a trot.

REASONS FOR DECISION

As “VIVID NIGHT” had clearly breached the Rule and Breaking Horse Regulations it was disqualified.

With the disqualification of “VIVID NIGHT” the final placings then read:

2nd      SHIFTY

3rd       STORMS ACOMING

4th      MARIA THERESA

Authorization was given for dividends and prize money to be paid on the stated placings.
