FACTS

Following the running of Race 4, Information A18951 was filed with the Adjudicative Committee.

Mr P McKay the Trainer of the second placed horse “PURRFECT PUSS” (N Parmar), protested against the first placed horse “MARTELL (J Fawcett), on the ground of interference rounding the final bend (350m).

All films were shown without comment.

SUBMISSIONS FOR DECISION

Mr McKay said that “MARTELL” pushed out on the corner and pushed his horse sideways and as it is a big-striding horse, it lost momentum.  He said that “MARTELL” kept coming out in the straight and that his horse would have easily beaten the winner (MARTELL).

Mr Parmar (PURRFECT PUSS) said that he was bumped for a few strides and could have easily won.

Mr Collett (MARTELL) said that it happened 350m from the winning post and that they came out for better ground.  He said that “PURRFECT PUSS” tried to ride in onto his runner.  He said that the second horse had ample time to catch his horse and that his horse was only flicked, whereas the other horse was hard ridden.

Mr Collett added that there was a lot of movement from other runners due to the heavy conditions.

Ms Fawcett said that the grass strips showed that she did not shift and added that she won comfortably.

REASON FOR DECISION

The Adjudicative Committee found that there was some movement and interference by “MARTELL” to “PURRFECT PUSS” near the 350m.  At that time, the horses “MARTELL” and “PURRFECT PUSS” were racing abreast.  At the end of the race, the margin was a ½ length.

The Adjudicative Committee took into account how both horses finished the race off from the 350m and was not convinced that “PURRFECT PUSS” would have beaten “MARTELL” if interference had not occurred near the 350m.

CONCLUSION

The protest was dismissed, with the Judge’s placings confirmed.

Authorisation was given for the payment of dividends and prize money on the Judge’s placings.
