Penalty: Apprentice Jockey, Niranjan Parmar is suspended for 10 days

EVIDENCE:

Following the running of Race 6, Mr Parmar admitted a charge of careless riding in that he permitted his mount to shift out when not sufficiently clear of PARADIGM SHIFT (Y Kumagai), which was crowded and checked approaching the 200m.

Mr Jones with the assistance of Mr Dooley, demonstrated on the videos the Respondent racing mid track towards the rear of the field, shift out behind horses and into the line of PARADIGM SHIFT, whose Rider, Yuto Kumagai had to take a strong hold of his horse.

DECISION:

As Mr Parmar admitted the breach it is found to be proved.

SUBMISSIONS FOR PENALTY:

Mr Jones produced the Respondent’s record which indicated 6 previous charges under the Rule in the last 12 months as follows:

2 April 2022 – Avondale 4 days

29 April 2022 – Rotorua 4 weeks causing a fall

30 July 2022 – Te Rapa 5 days

4 September 2022 – Pakuranga HC 9 days

30 September 2022 – Waikato RC 7 days

29 October 2022 – Matamata 8 days

Mr Jones said this would be the worst record going around at the minute. He said Mr Parmar has had 323 rides in the past 12 months and the Stewards believe this breach to be mid-range. Mr Jones said the overwhelming aggravating factor is Mr Parmar’s record.

Mr Harris said Mr Parmar is attending the riding school and they have seen a positive change in Mr Parmar’s technique. He said Mr Parmar is in his first season of riding in New Zealand and has had a lot of success but is still very much learning his trade.

REASONS FOR PENALTY:

Mr Parmar’s accumulation of suspensions appear to be no deterrent and in this regard, the Adjudicative Committee considered imposing a period of suspension rather than a number of days. The Adjudicative Committee appreciates that Mr Parmar is surrounded by the best personnel and advice in the business to improve his riding, however he is on notice that riding carelessly so often will not be tolerated endlessly.

The Adjudicative Committee in assessing all factors including Mr Parmar’s admission, considers a 10-day suspension as an appropriate penalty in the circumstances of this case. Deferment was discussed and Mr Walker on Mr Parmar’s behalf, said he would take any suspension immediately.

CONCLUSION:

Mr Parmar’s Apprentice Licence to ride in races is suspended from the end of riding today, up to and including racing on the 1 January 2023.
