Penalty: Apprentice Jockey, Niranjan Parmar is fined $500

EVIDENCE:

Following the running of Race 9, Mr Parmar admitted a charge of excessive use of the whip, in that he struck his mount BRIAN LAMONT 6 times prior to the 100m.

Using the available film, Stewards demonstrated the Respondent strike his mount 6 times in the home straight prior to the 100m.

Mr Parmar and Mr Harris had nothing to add.

DECISION:

As Mr Parmar admitted the breach it is found to be proved.

SUBMISSIONS ON PENALTY:

Mr Jones informed the Adjudicative Committee that Mr Parmar has had two previous breaches of this Rule:

30 July 2022 – fined $500 for 6 strikes

27 August 2022 – fined $250 for 6 strikes

Mr Jones said as this is Mr Parmar’s third breach within the 6-month timeframe, with one additional strike, a fine of $500 as per the Guidelines is warranted.

Mr Parmar and Mr Harris made no submissions on penalty.

REASONS FOR PENALTY:

Current Penalty Guidelines provide for a $500 fine in the circumstances for one additional strike, 3rd offence. The Adjudicative Committee considered that in this instance there were no aggravating factors and deemed that a fine at this level was therefore appropriate.

CONCLUSION:

Apprentice Jockey, Niranjan Parmar is fined $500.
