Evidence

Following the running of Race 7, the Respondent Triston Moodley admitted a charge alleging use of whip in consecutive strides over the concluding stages.

Mr D Mansour was present to assist

Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not:

(ii) strike a horse with a whip in consecutive strides at any stage of the race.

Using the available race films, Stipendiary Steward Mr Jones demonstrated that the Respondent struck his mount 2 times consecutively at the 75m mark.

Mr Moodley had no comment in relation to the incident.

Decision

As Mr Moodley admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions For Penalty

Mr Jones produced the Respondent’s record, which indicated that Mr Moodley had received a warning for consecutive use in the same race at around the 200m mark. This, being his second breach.

Mr Moodley offered no comment in relation to penalty.

Reasons For Penalty

The Penalty Guide starting point for a breach of this nature is;

2 consecutive, 2nd breach $150 fine.

The Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide.

On that basis, the Respondent is fined $150.

Conclusion

Mr Moodley is fined $150.
