Evidence :

At the conclusion of Race 1, the Wydham Workouts Committee Junior Drivers Trot, a protest was lodged by Stipendiary Steward, Mr V Munro alleging that the third placed horse by the Judge, CODY BANNER (M Hurrell) broke late in the run home and was lapped on by DWINDLE STAR (O Kite).

Mr Allen, the Trainer of CODY BANNER did not wish to be present at the hearing and did not contest the protest.

The judges placings were :

1st – No 2 King of the North ( T Nelly)

2nd – No 4 Winning Bones ( K Tomlinson)

3rd – No 7 Cody Banner ( M Hurrell)

4th – No 6 Dwindle Star ( O Kite)

The official margin between 3rd and 4th  3/4 of a length.

Rule 870(5) states : Notwithstanding the provisions of Sub Rule (4) hereof any horse which is not in the correct gait when it’s nose reaches the finish line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Adjudicative Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such a horse or its driver, then subject to Rule 869(8) such relegation of the horse shall be at the discretion of the Adjudicative Committee .

Mr Broad demonstrated on the video clip COADY BANNER galloping from about 30m to the winning post and highlighting that DWINDLE STAR’s nose was on the rump of CODY BANNER being lapped on.

It was clear from the video that COADY BANNER had galloped and was lapped on and had broken free of interference and accordingly CODY BANNER is in breach of rule 870(5).

CODY BANNER is relegated from 3rd placing to 4th placing.

The protest is upheld ,amended placings are:

1st – No 2 King of the North

2nd – No 4 Winning Bones

3rd – No 6  Dwindle Star

4th – No 7 Cody Banner

Stakes and dividends are to be paid accordingly.
